Werx – Limited Lifetime Screen Replacement Warranty

This Limited Lifetime Screen Replacement Warranty is provided to the original purchaser and end user (“You”) of a Werx screen replacement on a qualifying device (“Device”). Werx warrants to you that the screen replacement product will be free from material defects in manufacture and installation under normal use, will conform to Werx’s published product specifications and will be for normal use for as long as you own the device (the “Warranty Period”). In addition, should your screen become damaged after the initial screen repair, Werx will repair or replace, at its sole discretion, the device’s screen covered under this Warranty.

This Warranty does not cover damage caused by: (1) abuse, misuse, exposure to moisture or water; (2) unauthorized or incorrectly performed modications or repairs; (3) external causes or Acts of God; (3) normal wear and tear or cosmetic damage; (4) consumables (such as fuses or batteries); or (5) battery leakage. This Warranty is non-transferable and does not cover: (6) claims by persons other than You; (7) any Device on which the serial number has been altered, defaced or is missing; or (8) the costs to insure and ship the Device to Werx.

THIS LIMITED LIFETIME WARRANTY AND THE REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED. ANY IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR USE, SHALL BE LIMITED TO THE WARRANTY PERIOD; OTHERWISE THE REPLACEMENT OR REPAIR AS PROVIDED UNDER THIS WARRANTY IS YOUR EXCLUSIVE REMEDY TO THE FULL EXTENT PERMITTED BY LAW.

IN NO EVENT SHALL WERX BE LIABLE, WHETHER IN CONTACT OR TORT, INCLUDING NEGLIGENCE, FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND OR LOSS OF REVENUE OR PROFITS, LOSS OF BUSINESS, LOSS OF INFORMATION OR DATA, SOFTWARE OR APPLICATIONS OR OTHER FINANCIAL LOSS ARISING OUT OF OR IN CONNECTION WITH THE ABILITY OR INABILITY TO USE THE DEVICE OR THE REPAIR OF THE DEVICE.

If you feel the replacement part or repair service is faulty after receiving the repaired device back, you will have 90 days to contact us for warranty repair. During the first 90 days, Werx will repair the device at no additional cost if the part or service is found to be truly faulty and does not meet the exclusions listed above. After 90 days, Werx will repair the device at the regular sale price less 20% for as long as you own the device.

You are responsible for shipping the device to our repair facility, and return shipping will be delivered back via Fedex Ground (or FedEx Overnight for and additional charge). In repairing or replacing the Device, Werx may repair or replace the Device’s screen with a substitute part of like kind, quality and functionality. Substitute parts may have been remanufactured or may contain non-original manufacturer parts or be of a different brand, model or color. Some States do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to You. This Warranty gives You specific legal rights, and You may also have other rights which vary from State to State.
